Organization/Individual Requesting Data: The FIFRA Endangered Species Task Force L.L.C. (“FESTF”) is requesting precise data for the US to identify endangered species that may be affected by outdoor uses of a wide range of pesticide products and avoid adverse effects on the environment, including endangered species and habitat.

 

FESTF has been formed to provide for the acquisition and development of, or to secure access to, endangered species data and data analyses required by the United States Environmental Protection Agency ("EPA") under the Federal Insecticide, Fungicide, and Rodenticide Act ("FIFRA") and the Endangered Species Act ("ESA") to satisfy requirements related to, or for conducting risk assessments of, the potential for impacts of member company pesticide products on any species listed or proposed for listing as threatened or endangered under the ESA (“T&E species”). FESTF has developed, and is the sole owner of, a proprietary information management system ("Gopher") for satisfying the data registration and re-registration obligations of its members under FIFRA, and intends to (I) maintain the validated and populated Gopher, (2) provide EPA and other Federal agencies (as specified in this License Agreement) with access to the validated Gopher for use in conducting pesticide risk assessments on T&E species, and (3) meet any other requirements or needs for which the FESTF members may legally rely on T&E species data to support the evaluation and defense of pesticide products under the terms specified in this License Agreement.  More information can be found at FESTF.ORG – FIFRA Endangered Species Taskforce.


Purpose: NatureServe will work with FESTF to evaluate and implement a more streamlined approach to integrating the Licensed Dataset and Habitat Suitability Models for T&E species data into the FESTF Gopher system by using NatureServe Explorer, an Application Programming Interface (API) that allows two applications to talk to each other, or other methods of data integration. This deliverable would include evaluating the Gopher data model to identify opportunities for Gopher to directly access NatureServe element attribute data via the comprehensive NatureServe Explorer API library.

 

Scope of Data: The data provided to the FESTF under this License Agreement includes documented locations and suitable habitat models for T&E species that have a status under the Endangered Species Act (ESA). Details about the data provided are provided in the Data License Agreement.


In addition to integrating the Licensed Dataset in the FESTF Gopher system, NatureServe will provide FESTF Data Users with a subscription to NatureServe Explorer Pro starting in September 2021. This subscription will allow FESTF Data Users to interact directly with documented locations and predictive habitat models for T&E species with a status under the ESA for the uses described in Section V. below. FESTF Data Users will have the ability to query and generate reports for specific species or groups of species, or for areas drawn or uploaded. Explorer Pro also allows users to download or stream data into local GIS systems using APIs.

 

Data Sensitivity: Only certain groups that are identified in the Data License Agreement 2021-2023 (Appendix 1) have access to the Licensed Dataset.


NatureServe shall provide permission for FESTF to continue its use of the 2019-2021 licensed dataset (currently within FESTF possession as provided under the parties’ Fourth Amended and Restated Agreement for License of Threatened and Endangered Species Data and Support Services, as amended on May 2, 2019) until the Licensed Dataset is delivered. The Licensed Dataset will be delivered on or about October 1st, 2021, and will expire 24 months after the acceptance of the Licensed Dataset by FESTF (the “Activation Date”).
